1. Acceptance of Terms

By creating an account or using any part of the FarmPulse platform (web, mobile app, or API), you agree to these Terms of Service and our Privacy Policy. If you do not agree, you must not use the platform.

2. Eligibility

You must be at least 18 years of age to use FarmPulse. By using our platform, you represent that you are of legal age and have the authority to enter into this agreement. Farmers under 18 may use the platform with parental or guardian consent.

3. Use of the Platform

FarmPulse is provided for legitimate agricultural management purposes only. You agree not to use the platform for any unlawful purpose, to harass or harm other users, to transmit spam or malware, to attempt to gain unauthorized access to our systems, or to resell or redistribute our services without written permission.

4. Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately at support@farmpulse.co.ke if you suspect unauthorized access to your account.

5. Agricultural Data & Recommendations

FarmPulse provides crop recommendations, weather data, and pest alerts as informational tools only. These do not constitute professional agronomic advice. Always consult a qualified agronomist before making significant farm management decisions. We are not liable for crop losses resulting from actions taken based on platform data.

6. Intellectual Property

All content on FarmPulse including crop databases, algorithms, designs, and educational content is owned by AgriTech Analytics Ltd and is protected by Kenyan and international copyright laws. You may not copy, modify, or distribute our content without written permission.

7. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms, engage in fraudulent activity, or for any other reason at our discretion. Upon termination, your right to use the platform ceases immediately.

8. Limitation of Liability

To the maximum extent permitted by Kenyan law, AgriTech Analytics Ltd shall not be liable for any indirect, incidental, or consequential damages arising from your use of FarmPulse, including loss of crops, revenue, or data. Our total liability shall not exceed the amount paid by you for the service in the 12 months preceding the claim.

9. Governing Law

These Terms are governed by the laws of the Republic of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.
